1. Introduction
At Bixeler, we believe privacy is a fundamental right. We empower our users to control their online identity. This privacy policy explains how Bixeler, Inc. ("Bixeler," "we," or "us") collects, uses, and shares information about you when you interact with our services. These services include our websites, mobile apps, widgets, APIs, emails, and other online products and services (collectively, the "Services"). This policy also applies to any other interactions you have with us, such as receiving a communication from Bixeler.
We want this privacy policy to be clear and concise so you can make informed choices about how you use Bixeler. We encourage you to read the entire policy, but here's a quick summary:

Bixeler is a public platform. Most Experiences and Communities on Bixeler are public, meaning anyone can see your profile, posts, and comments.

We collect minimal information about you by default. You don't need an account to browse Bixeler anonymously. Even if you create an account to participate in a community and/or in experiences, you don't need to provide your real name. We don't track your exact location and you can browse anonymously. You control how much or how little information you share on Bixeler.

We only use data to improve Bixeler. Any data we collect is primarily used to deliver our Services, which help people connect and form communities/experiences. We do not sell your personal information to third parties and we never work with data brokers.

Privacy rights are for everyone at Bixeler. All users can request a copy of their data, account deletion, or information about our policies.

2. How We Use Your Information
At Bixeler, we use the information we collect about you to:

Help keep Bixeler and our users safe. This includes blocking potential spammers, addressing abuse, enforcing the Bixeler User Agreement and our other terms and policies, and complying with applicable laws.

Deliver, optimize, target, and measure the effectiveness of advertisements displayed on our Services.

3. Bixeler is a Public Platform
Much of the information on Bixeler is public and accessible to everyone, even without an account. By using Bixeler, you understand that this information is being shared publicly and freely.
When you submit content (like a post, review, promotion, comment, or chat message) to a public area of Bixeler, anyone visiting or using our Services will be able to see that content, the username associated with it, and the date and time you originally submitted it. This content and information may also be available in search results on search engines like Google. Consider the public nature of Bixeler before posting anything.
Your Bixeler account has a public profile page. This profile shows your activity on Bixeler, such as your username, past posts and comments, Rewards, earned points, profile display name, about section, social links, avatar or profile image, moderator, creator, and Bixeler Premium status, experiences you're active in, and how long you've been a member.
We offer social sharing features that let you share content or actions you take on Bixeler with other platforms. Using these features allows you to share certain information with your friends or the public, depending on the settings you establish with the third-party social sharing service. For more information about how these features collect and process data, please visit the privacy policies of the third parties that provide them (e.g., Instagram, Facebook, etc.).
Bixeler allows creators to access Bixeler content using moderator bots and tools. Bixeler also allows other third parties to access public Bixeler content using Bixeler's developer services, including Bixeler Embeds, our APIs, Developer Platform, and similar technologies. We limit third-party access to this content and require licensing fees for access to larger quantities of data. Bixeler's Developer Terms govern how these services are used by third parties.
4. How We Share Your Information
We may share your information in the following ways, in addition to the information that is displayed publicly as described above:

With your consent. We will always share information about you with your permission or at your direction.

With linked services. If you link your Bixeler account with a third-party service, Bixeler will share the information you authorize with that service. You can control this sharing as described in "Your Rights and Choices" below.

With our service providers. We may share information with vendors, consultants, and other service providers who need access to such information to perform work for us. Their use of your personal data will be subject to appropriate confidentiality and security measures. Here are some examples: (i) payment processors who handle transactions on our behalf, (ii) cloud providers who host our data and services, (iii) third-party ad measurement providers who help us and advertisers measure the performance of ads displayed on our Services, and (iv) compliance providers who help us determine your eligibility for Bixeler programs.

To comply with the law. We may share information if we believe disclosure is in accordance with, or required by, any applicable law, regulation, legal process, or government request, including, but not limited to, meeting national security or law enforcement requirements. To the extent the law allows it, we will attempt to provide you with prior notice before disclosing your information in response to such a request. In an emergency. We may share information if we believe it's necessary to prevent imminent and serious bodily harm to a person.

To enforce our rights and promote safety and security. We may share information if we believe your actions violate our User Agreement, rules, or other Bixeler terms and policies, or to protect the rights, property, and safety of the Services, ourselves, and others.

With our affiliates. We may share information between Bixeler and any of our parents, affiliates, subsidiaries, and other companies under common control and ownership.

Aggregated or de-identified information. We may share information about you that has been aggregated or anonymized such that it cannot reasonably be used to identify you. For example, we may show the total number of times a post has been liked without identifying who the users were, or we may tell an advertiser how many people saw their ad.
5. How We Protect Your Information
We take steps to protect information about you from loss, theft, misuse, unauthorized access, disclosure, alteration, and destruction. These measures include using HTTPS during information transmission and enforcing technical and administrative access controls to limit employee access to non-public personal information.
You can help maintain the security of your account by configuring two-factor authentication.
We store the information we collect for as long as necessary for the purposes for which it was originally collected. We may retain certain information for legitimate business purposes or if required by law. For example, if you violate our policies and your account is suspended, we may store identifiers used to create the account (such as phone number) to prevent you from creating new accounts.
6. Your Rights and Choices
At Bixeler, you have control over how your information is collected, used, and shared when you use our Services. Depending on your location, you may also have rights related to correcting your personal information, opting out of certain advertising practices, or withdrawing consent for processing information you previously authorized. Here's how to exercise these rights:

Access and update your information. You can access and update your profile information directly through your Bixeler account settings.

Delete your account. You can choose to delete your Bixeler account at any time. Once you delete your account, we will begin the process of removing your information from our systems. However, please note that there may be some residual information that remains due to legal or technical reasons.

Opt out of personalized advertising. You can control your preferences for personalized advertising by adjusting your settings within the Bixeler app or website.

Submit a data request. You can submit a request to access, rectify, delete, or export your personal information. You can also contact us at info@bixeler.io from the email address associated with your Bixeler account.
7. Verification is Required
Before processing any requests regarding your personal information, we need to verify your identity through your Bixeler account or a verified email address associated with your account. If we deny your request, you have the right to appeal the decision by contacting us at info@bixeler.io.
8. International Data Transfers
Bixeler, Inc. is located in Switzerland, and we process and store information on servers in Switzerland. We may also store information on servers and equipment in other countries depending on factors like user location and service provider location. By using Bixeler or providing information to us, you consent to the processing, transfer, and storage of your information in Switzerland and other countries. It's important to note that data protection laws may differ from those in your home country.
9. For Switzerland and the rest of EU Users
If you are located in the European Area, Bixeler Inc. Switzerland is the data controller for information processed in connection with the Bixeler platform and this policy.
Here are some additional rights for users in Switzerland and the rest of EU:

11. Children's Privacy
Bixeler is intended for a general audience and is not directed to children under the age of 16. We do not knowingly collect personal information from children under 16. If you are a parent or guardian and you are aware that your child has provided us with personal information, please contact us. If we become aware that we have collected personal information from a child under the age of 16, we will take steps to delete that information from our servers.
